Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you" or "Customer") and Fold Company ("Fold," "we," "us," or "our"), governing your access to and use of the Fold.page software, library, and related documentation, demos, and websites (collectively, the "Service"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Fold.page is a JavaScript library and related tooling that renders web page content as interactive 3D and WebXR graphics. The Service is distributed as source code, an npm package, and/or hosted script references, for you to integrate into websites and applications that you own or control.
2. License
Subject to your compliance with these Terms and payment of any applicable fees, Fold grants you a limited, non-exclusive, non-transferable, revocable license to use the Service on the terms described on our Pricing page and our Licence page, which are incorporated into these Terms by reference. Depending on the plan you select, your license may be limited to development/localhost use, a single production domain (and its subdomains), or custom terms agreed in writing for Enterprise customers. You may not sublicense, resell, or redistribute the Service as a standalone product, remove or obscure any proprietary notices, or use the Service to build a competing product, except as expressly permitted in writing by Fold.
3. Accounts, Purchases & Payment
Paid plans are processed through our third-party payment processor, Stripe. By making a purchase you authorize us (via Stripe) to charge your payment method for the applicable fees. We do not store your full payment card details — Stripe handles and secures that data directly. All fees are quoted and payable in the currency shown at checkout and are non-refundable except where required by law or expressly stated on the Pricing page. Prices and license terms are subject to change for future purchases; changes will not retroactively alter a license you have already purchased.
4. Acceptable Use
You agree not to, and not to permit others to:
- Use the Service for any unlawful, fraudulent, or harmful purpose;
- Reverse engineer, decompile, or attempt to derive the source code of any compiled or minified portion of the Service, except where applicable law permits;
- Circumvent, disable, or interfere with any license, domain-lock, or security mechanism in the Service;
- Use the Service in a way that infringes, misappropriates, or violates any third party's intellectual property or other rights; or
- Misrepresent your affiliation with Fold or use our name, logo, or trademarks without our prior written consent.
5. Your Content and Websites
You are solely responsible for the websites, applications, and content ("Your Content") that you build with or display through the Service, including its legality, accuracy, and effect on your users. Fold does not review, endorse, or take responsibility for Your Content and has no obligation to monitor how the Service is used.
6. Intellectual Property
The Service, including its source code, design, branding, and documentation, is owned by Fold and its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. You retain all rights to Your Content.
7. Third-Party Services and Materials
The Service may depend on, integrate with, or link to third-party software, open-source components, or services (including Stripe for payments). Those third-party materials are governed by their own terms and are not controlled by Fold. We are not responsible for the availability, accuracy, or conduct of any third-party service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FOLD DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPATIBLE WITH ANY PARTICULAR BROWSER, DEVICE, OR WEBSITE, OR THAT IT WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR RESULT. YOU USE THE SERVICE, AND INTEGRATE IT INTO ANY WEBSITE, ENTIRELY AT YOUR OWN RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FOLD, ITS OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE ON ANY WEBSITE — INCLUDING ANY DAMAGE TO OR MALFUNCTION OF A WEBSITE, LOSS OF DATA, OR THIRD-PARTY CLAIMS AGAINST YOU — EVEN IF FOLD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FOLD'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOLD FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify, defend, and hold harmless Fold and its officers, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content or the websites you use the Service on; (b) your violation of these Terms; or (c) your violation of any law or third-party right.
11. Term & Termination
These Terms remain in effect while you use the Service. We may suspend or terminate your access to the Service, including any license, if you materially breach these Terms and fail to cure that breach within a reasonable time after notice. Sections of these Terms which by their nature should survive termination (including Sections 6 and 8–13) will survive.
12. Changes to the Service or Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; material changes will be reflected by an updated "Last updated" date above, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of [State/Country of Incorporation — placeholder], without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in [Venue — placeholder], and you consent to the personal jurisdiction of those courts.
14. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent; we may assign these Terms freely. These Terms, together with the Pricing and Licence pages, constitute the entire agreement between you and Fold regarding the Service.
